General Terms & Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all provided services via the Swiss Biological Medicine Center AG, respectively for all legal transactions throughthe Swiss Biological Medicine Center AG. They are an integral part of every transaction between the Swiss Biological Medicine Center AG and the client (hereinafter referred to as customer). Changes and additional agreements are only effective if they are confirmed in writing by the Swiss Biological Medicine Center AG.

In other respects the provisions of the CO and other Swiss laws and regulations apply. If any provision of these terms and conditions is or becomes invalid or if the contract contains an omission, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provision an original valid provision shall be agreed upon which comes economically closest to the parties' requirements. The same applies in the case of an omission.

2. Offers

Our product offered are non-binding. Variations in color, appearance, texture and prices are subject to change. Technical modifications of articles, misprints, price mistakes and changed delivery partners are reserved.

3. Placing an order

Orders are finalized when the customer indicates this in the order process in the online shop. This becomes final with the issuance of the order confirmation.

If customers do not agree with the terms and conditions, they can make use of their right of withdrawal by rejecting acceptance of the terms and conditions during the order process.

If the customer requests an amendment in the placement and confirmation of the order, the customer will be notified by the Swiss Biological Medicine Center AG within one week whether the change is possible and what effect it has on the fulfillment of services, dates and costs. The Swiss Biological Medicine Center AG is obligated to offer changes in service for as long as a week.

4. Prices

Prices are quoted in CHF. VAT and processing are included. Shipping costs will be charged additionally. Price, color and product changes and errors reserved.

The provider reserves the right to change prices at any time. For customers, the order date prices are valid.

5. Terms of delivery

Delivery will be made as soon as possible. If within 14 days the goods have not been received by the customer, and no information has been provided, the customer is entitled to cancel the delivery.

For orders outside of Switzerland, the shipment will be made after receipt of the order value.

If one or more products are not available within 14 days, we will contact you.

Limitations may apply for export shipments. Medical deliveries in EU countries can only be carried out with limitations. These products can be picked up in our retail pharmacy. If the delivery cannot be executed due to legal or customs regulations, the customer will be informed and the order deleted.

6. Payment

Payment is made at the end of the ordering process with credit card.

The transmission of credit card information is based on the latest and highest safety of the company Saferpay, which performs payment processing.

The products remain the property of the Swiss Biological Medicine Center AG until payment is completed.

7. Cancellation right

If a customer cancels due to late delivery (delivery time longer than 14 days without proper notification by the Swiss Biological Medicine Center AG) or defects in the goods purchased, for which the online shop of the Swiss Biological Medicine Center AG is responsible, the amount already paid and return shipping costs are reimbursed.

The customer checks the delivered goods for possible defects immediately after receipt. Defects are to be reported to the Swiss Biological Medicine Center AG within 5 days in writing or by telephone. Minor customary variations based on material-specific properties are not considered defects.

Medications formulated according to customer specifications, ordered specifically for the customer or provided with custom labels cannot be returned. Likewise, sealed goods which are unsuitable for returning for health protection and hygiene reasons and were unsealed or broken after delivery.

Upon receipt of damaged goods the delivering company (mail or courier) should be notified. The return shipment must include sufficient postage. We have to charge you for defective, damaged or incomplete returns.

Otherwise, you have the right of return within 14 days from receipt of the goods. Please contact us before you return the goods by email or phone.

8. Warranty

Swiss Biological Medicine Center AG delivers flawless and original packaged products. Perishable products are marked with the expiration date. Beyond this date, a warranty is excluded. With regard to the quality and effectiveness of ordered products such as medications, health, hygiene and print products no guarantee can be made. Products may only be used in accordance with package insert or instructions for use; otherwisethe Swiss Biological Medicine Center AG is not responsible under warranty or liability. Technical aids have guarantee periods set by the manufacturer. The warranty period starts with the issuance of the invoice. Warranty claims on your part are quickly resolved by replacement or repair of defective article(s). Improper handling or personal intrusion will void the warranty. The warranty is not transferable to third parties.

The Swiss Biological Medicine Center AGG is not liable for defects and errors that it is not responsible for, especially safety deficiencies and operational failures of third party companies that it works with or is dependent on. The manufacturer is responsible for its product liability for product defects and their consequences.

Further, the online shop of the Swiss Biological Medicine Center AG is not liable for acts of God, improper handling and disregard for the risks by the customer or third parties, excessive strain, improper equipment of the customer or a third party, extreme environmental influences, customer intervention or interference by third parties (viruses, worms, etc.) that happen despite the necessary relevant safety precautions.

9. Modifications

The Swiss Biological Medicine Center AG has the right to change these terms and conditions at any time. Differing terms of the customer are not binding onthe Swiss Biological Medicine Center AG. Additional agreements must be in writing.

The jurisdiction is Teufen AR (Switzerland).
